I would rather spend my time helping the poor and the sick.

I wasn’t speaking in favor of Matthias, Paul, Joseph Smith, Pope Francis I, or Simon Cowell being the 12th judge. I just think that Jesus was saying that the Quorum of the Twelve Apostles from His time will assist Him on Judgement Day.

Except verse 9 says that Jesus was taken up, so presumably he wasn’t there when Matthias was chosen.

See Acts 1:21-22. So technically Matthias could count.

The scripture above does say, “the Twelve which were with me in my ministry at Jerusalem”. Matthias and Paul weren’t with Jesus.

Hence the question: is Judas Iscariot among them or is Matthias the one who would round out the Twelve? Or maybe Paul? My best guess is that the term “the Twelve” is used much like it is today – short for The Quorum of the Twelve Apostles, which is why Twelve is capitalized. So there probably doesn’t need to be 12 in the Twelve for it to function. That said, I figure 11 judges will work just fine.
